Overview
Marriage Is Meant to Bring Tranquility and Mercy
Calling marriage a contract does not make it cold or merely commercial. The Quran calls it a solemn covenant (4:21), and Prophetic teaching connects excellence in faith to conduct at home. Legal clarity protects affection: each spouse knows that love is supported by duties, property rights, and recourse when harm occurs.

Consent and Financial Security
Sahih al-Bukhari 5136 states that a previously married woman must be consulted and a virgin must give permission. Bukhari 5138 reports that the Prophet invalidated a marriage arranged against Khansa bint Khidam's wishes. These authentic texts make consent a legal requirement. Silence in the first hadith reflects a culturally shy but genuinely asked bride; it cannot be used to treat protest, fear, or coercion as consent.

Quran
O you who have believed, it is not lawful for you to inherit women by compulsion. And do not make difficulties for them in order to take [back] part of what you gave them unless they commit a clear immorality. And live with them in kindness. For if you dislike them - perhaps you dislike a thing and Allah makes therein much good.

Why Islam Restricted Polygyny
The Prophet was monogamous with Khadija for roughly twenty-five years. His later marriages took place in a community shaped by widowhood, tribal ties, teaching, and public responsibility. This history does not make polygyny a requirement or the normal choice for every man. It is a conditional permission carrying serious duties.
Justice includes time, housing, maintenance, and outward treatment. Secret relationships, financial neglect, and emotional manipulation do not become righteous through invoking Quran 4:3. Muslim legal systems differ over whether a marriage contract may include a monogamy condition and what remedy follows its breach, but the moral warning is common: the permission is a responsibility for which the husband answers to Allah.

And if you fear that you will not deal justly with the orphan girls, then marry those that please you of [other] women, two or three or four. But if you fear that you will not be just, then [marry only] one or those your right hand possesses. That is more suitable that you may not incline [to injustice].

Divorce Is Regulated, Not Forbidden
Surah al-Baqarah (2:229) describes khul, and Sahih al-Bukhari 5274 records the Prophet ordering separation after the wife of Thabit ibn Qays agreed to return the garden given as mahr. She did not accuse her husband of bad religion or character; she feared she could not continue the marriage well. The report shows that Islamic separation is not restricted to proving physical abuse.

And when you divorce women and they have [nearly] fulfilled their term, either retain them according to acceptable terms or release them according to acceptable terms, and do not keep them, intending harm, to transgress [against them]. And whoever does that has certainly wronged himself. And do not take the verses of Allah in jest. And remember the favor of Allah upon you and what has been revealed to you of the Book and wisdom by which He instructs you. And fear Allah and know that Allah is Knowing of all things.

Divorce is twice. Then, either keep [her] in an acceptable manner or release [her] with good treatment. And it is not lawful for you to take anything of what you have given them unless both fear that they will not be able to keep [within] the limits of Allah. But if you fear that they will not keep [within] the limits of Allah, then there is no blame upon either of them concerning that by which she ransoms herself. These are the limits of Allah, so do not transgress them. And whoever transgresses the limits of Allah - it is those who are the wrongdoers.

Abuse Violates the Prophetic Model
The final sermon also instructed men to fear Allah concerning women. Good marriage counseling should hold both spouses accountable without pretending that every conflict has equal power or equal danger. Where there is violence, threats, or coercion, joint counseling can be unsafe. Protection, documentation, and competent authorities may be necessary before any conversation about reconciliation.
interpretation
Age, Capacity, and Protection
A historical norm can be lawful in its own context without becoming a recommended age for every society. Islamic legal maxims against harm and the ruler's authority to regulate permissible matters for public welfare support protective legislation. A marriage that predictably destroys health, education, or meaningful consent contradicts the responsibilities marriage is meant to carry.
summary
A Covenant Accountable to Allah
Christian traditions often honor lifelong marriage with great seriousness, and Muslims can appreciate that commitment. Islam's permission for divorce addresses another moral reality: some unions become unlivable or dangerous. By honoring marriage without making it an inescapable sacrament, Islamic law combines aspiration with a remedy for human failure.
